Terms of Service

These terms govern your use of AirPunk. By creating an account you agree to them. If you are using AirPunk on behalf of a company, you confirm you may bind it.

What AirPunk does

You describe a brand. AirPunk researches its market, sets a strategy, art-directs it, builds and publishes a storefront, produces advertising creative, takes orders through that storefront, and continues to operate it. Much of this is done by AI systems working on your instructions.

Your account

  • You must be at least 16 and able to enter a contract.
  • Accounts are created through Clerk, using email, Sign in with Apple, or Google.
  • You are responsible for activity under your account. Tell us promptly if you suspect unauthorised access.
  • One human, one account. Do not share credentials.

Subscriptions and credits

The billing model is deliberately simple, and it is the only rule:

  • One subscription covers one brand. A second brand needs a second subscription.
  • Monthly credits are attached to the brand whose subscription produced them. They renew each period and do not roll over.
  • Credits bought individually as refills belong to the account and can be spent on any of your brands.

Credits pay for generation work — research, design, site builds, images, video, ad creative. Prices and credit costs are shown in the product and may change with notice for future periods. Credits have no cash value and are not redeemable outside AirPunk.

Payment and renewal

On the web, payments are processed by Stripe. On iOS, purchases are processed by Apple and managed through RevenueCat, subject to Apple's terms — including Apple's own refund process, which we cannot override. Subscriptions renew automatically until cancelled. Cancel any time; access continues to the end of the paid period.

Refunds

Because credits are consumed by generation work that costs us real compute the moment it runs, consumed credits are not refundable. If something goes wrong on our side, contact us — we will make it right. Statutory rights, including any right of withdrawal you have as a consumer under French and EU law, are unaffected.

What you are responsible for

AirPunk builds and operates a business for you. It is still your business.

  • You are the publisher of the sites and content AirPunk produces for you, and the seller of anything sold through them.
  • You are responsible for the legality of your products, the accuracy of your claims and prices, your taxes, and fulfilling orders your storefront takes.
  • You must have the rights to any brand names, trademarks, images or material you supply.
  • You are responsible for your own compliance with consumer law and data protection law towards your customers.

AI output

Generated content can be wrong, generic, or unsuitable. Review it before you publish or sell. We make no promise that generated material is unique, accurate, or fit for a particular purpose, and no promise about traffic, sales or revenue. AirPunk is a tool, not a guarantee of a successful business.

As between you and us, you own the content AirPunk generates for your brand. You grant us the licence needed to host, display and operate it as part of providing the service.

Acceptable use

You may not use AirPunk to build, promote or sell:

  • anything illegal where it is offered, or counterfeit or infringing goods;
  • weapons, drugs, or regulated products you are not licensed to sell;
  • sexual content, or content that harasses, defames, or incites hatred or violence;
  • scams, deceptive claims, or schemes designed to mislead buyers;
  • anything that impersonates a real person or organisation without authority.

You also may not attempt to break, overload or reverse-engineer the service, or use it to train a competing model. We may suspend or terminate accounts that breach this section, and will remove content we are legally required to remove.

Availability

We work to keep AirPunk running and deploy improvements continuously, but we do not promise uninterrupted or error-free service. Generation depends on third-party AI providers whose availability we do not control; when one is unavailable, AirPunk routes to another where it can.

Liability

Nothing here excludes liability that cannot be excluded by law, including for death, personal injury, fraud, or gross negligence. Subject to that, and to the fullest extent permitted by law, our total liability arising from the service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for lost profits, lost revenue, lost data, or indirect or consequential loss.

Suspension and termination

You may stop using AirPunk and delete your account at any time; deletion removes your brands and their generated data. We may suspend or terminate an account for breach of these terms, non-payment, or where required by law. Published storefronts stop being served when the account or brand ends.

Changes

We may update these terms as the product changes. We will update the date above and, for material changes, notify account holders. Continuing to use AirPunk after a change means you accept the updated terms.

Governing law

These terms are governed by French law. Disputes fall to the courts of Paris, France, except where consumer law gives you the right to bring proceedings in your own country of residence. Consumers may also use the EU online dispute resolution platform.
